| relating to the authority of certain counties to restrict the use of | ||
| engine braking. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 542, Transportation Code, | ||
| is amended by adding Section 542.207 to read as follows: | ||
| Sec. 542.207. ENGINE BRAKING RESTRICTIONS IN CERTAIN | ||
| COUNTIES. The commissioners court of a county with a population of | ||
| 150,000 or more by order may prohibit or otherwise restrict in the | ||
| unincorporated area of the county the use of engine braking. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2021. | ||
