relating to the reimbursement of excess costs incurred by a | ||
recipient of certain grants awarded by the Texas Department of | ||
Transportation. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter I, Chapter 201, Transportation Code, | ||
is amended by adding Section 201.713 to read as follows: | ||
Sec. 201.713. REIMBURSEMENT OF EXCESS COSTS INCURRED BY | ||
CERTAIN GRANT RECIPIENTS. (a) This section applies only to a grant | ||
awarded by the department for the construction of a transportation | ||
project in a county with a population of less than 25,000 or a | ||
municipality with a population of less than 15,000. | ||
(b) The department shall reimburse a grant recipient for | ||
costs incurred by the recipient that exceed the amount of the grant | ||
awarded by the department if the construction of the transportation | ||
project is managed by the department. | ||
SECTION 2. The change in law made by this Act applies only | ||
to a grant awarded by the Texas Department of Transportation on or | ||
after the effective date of this Act. A grant awarded before the | ||
effective date of this Act is governed by the law in effect on the | ||
date the award was made, and the former law is continued in effect | ||
for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2023. |
