relating to the allocation of certain federal career and technical | ||
education funds. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 7.109(d), Education Code, is amended to | ||
read as follows: | ||
(d) The State Board for Career and Technology Education may | ||
allocate funds appropriated to the board by the legislature or | ||
federal funds received by the board under the Carl D. Perkins Career | ||
and Technical [ |

2301 et seq.) or other federal law to an institution or program | ||
approved by the State Board of Education, the Texas Higher | ||
Education Coordinating Board, or another state agency specified by | ||
law. At least 40 percent of any federal funds allocated by the | ||
State Board for Career and Technology Education under this | ||
subsection must be allocated to support career and technical | ||
education at the postsecondary or adult level. | ||
SECTION 2. The change in law made by this Act to Section | ||
7.109, Education Code, applies beginning with an allocation of | ||
federal funds made on or after the expiration of the Texas State | ||
Plan for Career and Technical Education, 2008-2013. | ||
SECTION 3. This Act takes effect September 1, 2011. |
