relating to a prohibition on the issuance of a drilling permit for | ||
an oil or gas well that is proposed to be located within a specified | ||
distance of a public school. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 38, Education Code, is | ||
amended by adding Section 38.027 to read as follows: | ||
Sec. 38.027. PROHIBITION ON PERMIT FOR OIL OR GAS WELL TO BE | ||
LOCATED NEAR PUBLIC SCHOOL. The Railroad Commission of Texas may | ||
not issue a drilling permit for an oil or gas well that is proposed | ||
to be located less than 1,200 feet from a public school. | ||
SECTION 2. The change in law made by this Act applies only | ||
to a drilling permit the application for which is filed with the | ||
Railroad Commission of Texas on or after the effective date of this | ||
Act. A drilling permit the application for which is filed with the | ||
commission before the effective date of this Act is subject to the | ||
law in effect on the date the application is filed, and that law is | ||
continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2011. |
