A BILL TO BE ENTITLED
 
AN ACT
  relating to a prohibition on the issuance of a drilling permit for
  an oil or gas well that is proposed to be located within a specified
  distance of a public school.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 38, Education Code, is
  amended by adding Section 38.027 to read as follows:
         Sec. 38.027.  PROHIBITION ON PERMIT FOR OIL OR GAS WELL TO BE
  LOCATED NEAR PUBLIC SCHOOL.  The Railroad Commission of Texas may
  not issue a drilling permit for an oil or gas well that is proposed
  to be located less than 1,200 feet from a public school.
         SECTION 2.  The change in law made by this Act applies only
  to a drilling permit the application for which is filed with the
  Railroad Commission of Texas on or after the effective date of this
  Act.  A drilling permit the application for which is filed with the
  commission before the effective date of this Act is subject to the
  law in effect on the date the application is filed, and that law is
  continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2011.
