A BILL TO BE ENTITLED
 
AN ACT
  relating to the use of parental leave, family and medical leave,
  vacation leave, and sick leave by certain state employees.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 661.252(b), Government Code, is amended
  to read as follows:
         (b)  The policy must provide clear and objective guidelines
  to establish under what circumstances an employee of the agency may
  be entitled to or granted:
               (1)  parental leave;
               (2)  family and medical leave;
               (3)  vacation leave;
               (4)  sick leave; and
               (5)  each other type of leave provided by this chapter.
         SECTION 2.  Section 661.912(b), Government Code, is amended
  to read as follows:
         (b)  An [The employee must first use all available and
  applicable paid vacation and sick leave while taking leave under
  this section, except that an] employee who is receiving temporary
  disability benefits or workers' compensation benefits while taking
  leave under this section is not required to [first] use
  [applicable] paid vacation or sick leave [while receiving those
  benefits].
         SECTION 3.  Section 661.913(b), Government Code, is
  repealed.
         SECTION 4.  This Act takes effect September 1, 2023.
