| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 43.002, Local Government Code, is | ||
| amended by adding Subsection (e) to read as follows: | ||
| (e) A regulation relating to the sale and use of fireworks | ||
| is subject to the restrictions in Section 43.133. | ||
| SECTION 2. Subchapter F, Chapter 43, Local Government Code, | ||
| is amended by adding Section 43.133 to read as follows: | ||
| Sec. 43.133. SALE OR USE OF FIREWORKS IN ANNEXED AREA. A | ||
| municipality that annexes an area for limited purposes under this | ||
| subchapter may not prohibit the sale or use of fireworks in the | ||
| area. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
