A BILL TO BE ENTITLED
 
AN ACT
  relating to approval of the study of, design for, and construction
  of a proposed toll project by the commissioners court of the county
  in which the toll project is to be located.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 372, Transportation Code,
  is amended by adding Section 372.002 to read as follows:
         Sec. 372.002.  COMMISSIONERS COURT APPROVAL REQUIRED. (a) A
  toll project entity or metropolitan planning organization must
  obtain, by a three-fifths vote, approval of the commissioners court
  of the county in which a toll project is proposed to be located
  before the toll project entity or metropolitan planning
  organization may:
               (1)  conduct a feasibility study for the project;
               (2)  develop a design for the project; or
               (3)  enter into a construction contract for the
  project.
         (b)  A toll project entity or metropolitan planning
  organization is required by Subsection (a) to obtain separate
  approval before each of the actions specified by Subsections
  (a)(1), (2), and (3).
         SECTION 2.  Section 372.002, Transportation Code, as added
  by this Act, does not apply to a toll project for which:
               (1)  a feasibility study has been conducted or a plan or
  design has been developed before September 1, 2015; or
               (2)  a contract for construction has been entered into
  before September 1, 2015.
         SECTION 3.  This Act takes effect September 1, 2015.
