BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 29.01, Penal Code, is amended by adding | ||
Subdivision (3) to read as follows: | ||
(3) "Credit services organization" has the meaning | ||
assigned by Section 393.001, Finance Code. | ||
SECTION 2. Chapter 29, Penal Code, is amended by adding | ||
Section 29.04 to read as follows: | ||
Sec. 29.04. JUGGING. (a) A person commits an offense if, | ||
with the intent to commit theft of another person's money, the | ||
person: | ||
(1) targets or observes the other person withdrawing | ||
money from an automated teller machine, bank, credit union, or | ||
credit services organization; and | ||
(2) subsequently physically follows the other person | ||
or causes any person to physically follow the other person. | ||
(b) An offense under this section is a state jail felony, | ||
except that the offense is: | ||
(1) a felony of the third degree if, during the | ||
commission of the offense, the actor commits an offense under | ||
Section 30.04; or | ||
(2) a felony of the first degree if, during the | ||
commission of the offense, the actor commits an offense under | ||
Section 29.02 or 29.03. | ||
SECTION 3. This Act takes effect September 1, 2025. |
