relating to the recommendations made by the Sunset Advisory | ||
Commission regarding state agencies reviewed under the Texas Sunset | ||
Act. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 325.012, Government Code, is amended by | ||
adding Subsection (a-1) to read as follows: | ||
(a-1) In its report on a state agency under Subsection (a), | ||
the commission may only make recommendations that relate to | ||
procedural changes in the day-to-day operation or function of the | ||
state agency, including recommendations related to internal | ||
business operating procedures of the agency and administrative | ||
functions that do not require or are not affected by the unique | ||
subject matter responsibilities of the agency, such as changes to | ||
the general employment policy, the career ladder program, equal | ||
opportunity policies, public interest information and public | ||
participation policies, and the procedural method for issuing a | ||
license or resolving a complaint. The commission may not make | ||
recommendations that relate to substantive changes in the operation | ||
or function of the agency, including recommendations related to: | ||
(1) the expansion or contraction of the subject matter | ||
responsibilities of the agency; | ||
(2) a restriction on the deliberative process of a | ||
state agency's governing board; | ||
(3) a change to the qualifications for a license or the | ||
activities for which a license issued by the agency is required; | ||
(4) a change to the rulemaking authority of the agency | ||
as it relates to the agency's enforcement of its subject matter; | ||
(5) a change to the scope of practice of the holder of | ||
a license issued by the agency; and | ||
(6) agency penalty and enforcement provisions. | ||
SECTION 2. This Act takes effect September 1, 2015. |
