| relating to recall elections for members of the governing body of a | ||
| home-rule municipality who are elected from single-member | ||
| districts. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 26, Local Government Code, | ||
| is amended by adding Section 26.048 to read as follows: | ||
| Sec. 26.048. RECALL ELECTIONS IN SINGLE-MEMBER DISTRICTS. | ||
| (a) This section applies to a municipality that has a single-member | ||
| district form of representation for the governing body of the | ||
| municipality. | ||
| (b) A municipality may not adopt or enforce an ordinance or | ||
| charter provision authorizing an election by the municipality at | ||
| large for the recall of a member of the municipality's governing | ||
| body who was elected from a single-member district. Only voters of a | ||
| single-member district may vote in an election to recall a member | ||
| of the governing body who was elected from the district. | ||
| SECTION 2. This Act takes effect September 1, 2021. | ||
