relating to recall elections for members of the governing body of a | ||
home-rule municipality who are elected from single-member | ||
districts. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 26, Local Government Code, | ||
is amended by adding Section 26.048 to read as follows: | ||
Sec. 26.048. RECALL ELECTIONS IN SINGLE-MEMBER DISTRICTS. | ||
(a) This section applies to a municipality that has a single-member | ||
district form of representation for the governing body of the | ||
municipality. | ||
(b) A municipality may not adopt or enforce an ordinance or | ||
charter provision authorizing an election by the municipality at | ||
large for the recall of a member of the municipality's governing | ||
body who was elected from a single-member district. Only voters of a | ||
single-member district may vote in an election to recall a member | ||
of the governing body who was elected from the district. | ||
SECTION 2. This Act takes effect September 1, 2021. |
