relating to the preference given by state agencies for certain | ||
goods and services produced or offered by small businesses. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter H, Chapter 2155, Government Code, is | ||
amended by adding Section 2155.454 to read as follows: | ||
Sec. 2155.454. PREFERENCE FOR SMALL BUSINESS. (a) In this | ||
section, "small business" has the meaning assigned by Section | ||
2155.505. | ||
(b) Except as provided by Subsection (c), the comptroller | ||
and each state agency that enters into a contract for the purchase | ||
of goods or services with a value of less than $500,000 shall give | ||
preference to goods or services produced or offered by a small | ||
business. | ||
(c) This section does not apply to the purchase of | ||
telecommunications equipment, telecommunications service, | ||
advanced communications services, or information service, as those | ||
terms are defined by 47 U.S.C. Section 153. | ||
(d) The comptroller may adopt rules to implement this | ||
section. | ||
SECTION 2. The change in law made by this Act applies only | ||
to a contract for goods or services that is entered into on or after | ||
the effective date of this Act. A contract entered into before the | ||
effective date of this Act is governed by the law in effect on the | ||
date the contract was entered into, and the former law is continued | ||
in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2019. |
