relating to permits to construct reservoirs for the storage of | ||
state water. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 11.124(f), Water Code, is amended to | ||
read as follows: | ||
(f) If the application is for a permit to construct a | ||
storage reservoir, the application must also contain: | ||
(1) a draft permit authorizing the construction of the | ||
reservoir; and | ||
(2) evidence that the applicant has mailed notice of | ||
the application to each member of the governing body of each county | ||
and municipality in which the reservoir, or any part of the | ||
reservoir, will be located. | ||
SECTION 2. Section 11.134, Water Code, is amended by adding | ||
Subsection (d) to read as follows: | ||
(d) The commission shall grant or deny an application for a | ||
permit to construct a storage reservoir not later than the 180th day | ||
after the date on which the commission receives the application. If | ||
the commission does not grant or deny the application on or before | ||
that date, the commission is considered to have granted the | ||
application and issued the draft permit included in the | ||
application. | ||
SECTION 3. The changes in law made by this Act apply only to | ||
an application for a permit to construct a storage reservoir filed | ||
with the Texas Commission on Environmental Quality on or after the | ||
effective date of this Act. An application filed before the | ||
effective date of this Act is governed by the law in effect on the | ||
date the application was filed, and the former law is continued in | ||
effect for that purpose. | ||
SECTION 4. This Act takes effect September 1, 2013. |
