A BILL TO BE ENTITLED
AN ACT
relating to permits to construct reservoirs for the storage of
state water.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 11.124(f), Water Code, is amended to
read as follows:
(f) If the application is for a permit to construct a
storage reservoir, the application must also contain:
(1) a draft permit authorizing the construction of the
reservoir; and
(2) evidence that the applicant has mailed notice of
the application to each member of the governing body of each county
and municipality in which the reservoir, or any part of the
reservoir, will be located.
SECTION 2. Section 11.134, Water Code, is amended by adding
Subsection (d) to read as follows:
(d) The commission shall grant or deny an application for a
permit to construct a storage reservoir not later than the 180th day
after the date on which the commission receives the application. If
the commission does not grant or deny the application on or before
that date, the commission is considered to have granted the
application and issued the draft permit included in the
application.
SECTION 3. The changes in law made by this Act apply only to
an application for a permit to construct a storage reservoir filed
with the Texas Commission on Environmental Quality on or after the
effective date of this Act. An application filed before the
effective date of this Act is governed by the law in effect on the
date the application was filed, and the former law is continued in
effect for that purpose.
SECTION 4. This Act takes effect September 1, 2013.
