A BILL TO BE ENTITLED
AN ACT
relating to the prosecution of the criminal offenses of firearm and
ammunition smuggling and terrorism.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The heading to Section 46.14, Penal Code, is
amended to read as follows:
Sec. 46.14. FIREARM AND AMMUNITION SMUGGLING.
SECTION 2. Section 46.14(a), Penal Code, is amended to read
as follows:
(a) A person commits an offense if the person knowingly
engages in the business of transporting or transferring a firearm
or ammunition for a firearm that the person knows was acquired in
violation of the laws of any state or of the United States. For
purposes of this subsection, a person is considered to engage in the
business of transporting or transferring a firearm or ammunition
for a firearm if the person engages in that conduct:
(1) on more than one occasion; or
(2) for profit or any other form of remuneration.
SECTION 3. Section 76.02(a), Penal Code, is amended to read
as follows:
(a) A person commits an offense if the person:
(1) commits or conspires to commit an offense under:
(A) Chapter 16;
(B) Chapter 19;
(C) [(B)] Section 20.02;
(D) [(C)] Section 20.03;
(E) Section 20.04;
(F) Section 20.05;
(G) Section 20.06;
(H) [(D)] Section 20A.02;
(I) [(E)] Section 22.02;
(J) [(F)] Section 22.021;
(K) [(G)] Section 22.05, if punishable as a
felony;
(L) [(H)] Section 22.07, if punishable as a
felony;
(M) [(I)] Section 22.09;
(N) Section 22.11;
(O) [(J)] Section 28.02;
(P) Section 28.03;
(Q) [(K)] Section 28.07, if punishable as a
felony;
(R) [(L)] Section 29.03;
(S) Section 30.05;
(T) Section 32.43;
(U) Section 32.51;
(V) Section 33.02;
(W) Chapter 33A;
(X) Section 37.11;
(Y) Section 37.12;
(Z) Section 38.05;
(AA) Section 38.14;
(BB) [(M)] Section 38.152, if punishable as a
felony; [or]

(2) commits or conspires to commit that offense with
the intent to:
(A) intimidate or coerce the public or a
substantial group of the public; or
(B) influence, by intimidation or coercion, the
policy, conduct, or activities of this state, a political
subdivision of this state, or the United States.
SECTION 4. The change in law made by this Act applies only
to an offense committed on or after the effective date of this Act.
An offense committed before the effective date of this Act is
governed by the law in effect on the date the offense was committed,
and the former law is continued in effect for that purpose. For
purposes of this section, an offense was committed before the
effective date of this Act if any element of the offense occurred
before that date.
SECTION 5. This Act takes effect September 1, 2025.
