A BILL TO BE ENTITLED
 
AN ACT
  relating to evaluating the adequacy of education provided to
  children in county jails.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 25, Education Code, is
  amended by adding Section 25.00112 to read as follows:
         Sec. 25.00112.  ADEQUACY OF EDUCATION PROVIDED TO CERTAIN
  CHILDREN IN COUNTY JAILS. (a) This section applies to a child who
  is under 18 years of age who is confined to a county jail.
         (b)  The agency shall evaluate the adequacy of educational
  services provided to children described by Subsection (a)
  throughout the state.
         (c)  If the agency finds that the educational services
  provided to children described by Subsection (a) are insufficient,
  the commissioner shall adopt rules requiring each school district
  in which a county jail is located to take actions and provide
  services to address any deficiencies.
         (d)  The agency shall submit a report on its findings under
  this section and, if applicable, any rules adopted or other actions
  taken by the agency to the legislature not later than January 1 of
  each odd-numbered year. The report may include legislative
  recommendations.
         (e)  This section expires September 1, 2017.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
