children in county jails. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 25, Education Code, is | ||
amended by adding Section 25.00112 to read as follows: | ||
Sec. 25.00112. ADEQUACY OF EDUCATION PROVIDED TO CERTAIN | ||
CHILDREN IN COUNTY JAILS. (a) This section applies to a child who | ||
is under 18 years of age who is confined to a county jail. | ||
(b) The agency shall evaluate the adequacy of educational | ||
services provided to children described by Subsection (a) | ||
throughout the state. | ||
(c) If the agency finds that the educational services | ||
provided to children described by Subsection (a) are insufficient, | ||
the commissioner shall adopt rules requiring each school district | ||
in which a county jail is located to take actions and provide | ||
services to address any deficiencies. | ||
(d) The agency shall submit a report on its findings under | ||
this section and, if applicable, any rules adopted or other actions | ||
taken by the agency to the legislature not later than January 1 of | ||
each odd-numbered year. The report may include legislative | ||
recommendations. | ||
(e) This section expires September 1, 2017. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
