| relating to analysis of and reports on customer response to | ||
| conservation appeals in ERCOT. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is | ||
| amended by adding Section 39.920 to read as follows: | ||
| Sec. 39.920. RESPONSE TO CONSERVATION APPEALS. (a) The | ||
| independent organization certified under Section 39.151 for the | ||
| ERCOT power region shall collect for each zip code in ERCOT | ||
| information showing the response by retail electric customers in | ||
| that zip code to conservation appeals issued by the independent | ||
| organization. | ||
| (b) Notwithstanding any provision in Chapter 17, Section | ||
| 39.101, or Section 39.107: | ||
| (1) the independent organization certified under | ||
| Section 39.151 for the ERCOT power region may request that an | ||
| electric cooperative, municipally owned utility, retail electric | ||
| provider, or transmission and distribution utility provide to the | ||
| independent organization information to allow the independent | ||
| organization to comply with Subsection (a); and | ||
| (2) in response to a request described by Subdivision | ||
| (1), an electric cooperative, municipally owned utility, retail | ||
| electric provider, or transmission and distribution utility shall | ||
| provide the information to the independent organization. | ||
| (c) An electric cooperative, municipally owned utility, | ||
| retail electric provider, or transmission and distribution utility | ||
| may not provide individual retail electric customer usage data or | ||
| personal information to the independent organization certified | ||
| under Section 39.151 for the ERCOT power region in response to a | ||
| request received under this section. | ||
| (d) The independent organization certified under Section | ||
| 39.151 for the ERCOT power region shall: | ||
| (1) at least quarterly publish on the independent | ||
| organization's Internet website updated analyses of the response by | ||
| retail electric customers in ERCOT to conservation appeals issued | ||
| by the independent organization; and | ||
| (2) submit to the legislature an annual report | ||
| summarizing the analyses published under Subdivision (1). | ||
| SECTION 2. This Act takes effect September 1, 2025. | ||
