A BILL TO BE ENTITLED
AN ACT
relating to financial assistance for resident undergraduate and
graduate students.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 56.011, Education Code, is amended by
adding Subsection (d) to read as follows:
(d) This section does not apply to an increase in tuition in
excess of $46 per semester credit hour that occurs after February 1,
2011, to the extent that such an increase is matched by an equal
reduction in required student fees.
SECTION 2. Section 56.012, Education Code, is amended by
adding Subsection (d) to read as follows:

SECTION 3. EFFECTIVE DATE. This Act takes effect
immediately if it receives a vote of two-thirds of all the members
elected to each house, as provided by Section 39, Article III, Texas
Constitution. If this Act does not receive the vote necessary for
immediate effect, this Act takes effect September 1, 2011.
