| relating to export fees charged by the Middle Pecos Groundwater | ||
| Conservation District; changing a fee. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 8851.104(b), Special District Local Laws | ||
| Code, is amended to read as follows: | ||
| (b) In addition to other fees assessed by the district, the | ||
| district may assess a fee on groundwater transferred out of the | ||
| district in accordance with Section 36.122(e)(1) or (2), Water | ||
| Code, in an amount not to exceed 10 percent of the amount of the fee | ||
| assessed for the production of water for use in the district if a | ||
| production fee is assessed. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
