relating to the waiver of certain examination requirements for | ||
certain applicants for an engineering license. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 1001.305, Occupations Code, is amended | ||
to read as follows: | ||
Sec. 1001.305. WAIVER OF EXAMINATION REQUIREMENT. (a) The | ||
board by rule may waive all or part of the examination requirement | ||
for an applicant for the issuance or reissuance of a license under | ||
this chapter. The board may not waive the requirement unless the | ||
board first determines that: | ||
(1) the applicant possesses sufficient qualifications | ||
to justify the waiver; and | ||
(2) issuing or reissuing the license to the applicant | ||
does not pose a threat to the public health, safety, or welfare. | ||
(b) The board shall waive the fundamentals of engineering | ||
examination requirement for an applicant for the issuance or | ||
reissuance of a license under this chapter, regardless of whether | ||
the applicant has previously failed a fundamentals of engineering | ||
examination in this state or another jurisdiction, if: | ||
(1) the applicant has engaged in the active practice | ||
of engineering for at least 15 years; | ||
(2) the board determines that issuing or reissuing the | ||
license to the applicant does not pose a threat to the public | ||
health, safety, or welfare; | ||
(3) the applicant requests a waiver in writing at the | ||
time the application is filed; and | ||
(4) the applicant meets the educational requirement of | ||
Section 1001.302(a)(1). | ||
SECTION 2. Section 1001.305, Occupations Code, as amended | ||
by this Act, applies only to an application for an engineering | ||
license that is filed on or after the effective date of this Act. An | ||
application that was filed before the effective date of this Act is | ||
governed by the law in effect on the date the application was filed, | ||
and the former law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2025. |
