A BILL TO BE ENTITLED
 
AN ACT
  relating to the waiver of certain examination requirements for
  certain applicants for an engineering license.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1001.305, Occupations Code, is amended
  to read as follows:
         Sec. 1001.305.  WAIVER OF EXAMINATION REQUIREMENT.  (a) The
  board by rule may waive all or part of the examination requirement
  for an applicant for the issuance or reissuance of a license under
  this chapter.  The board may not waive the requirement unless the
  board first determines that:
               (1)  the applicant possesses sufficient qualifications
  to justify the waiver; and
               (2)  issuing or reissuing the license to the applicant
  does not pose a threat to the public health, safety, or welfare.
         (b)  The board shall waive the fundamentals of engineering
  examination requirement for an applicant for the issuance or
  reissuance of a license under this chapter, regardless of whether
  the applicant has previously failed a fundamentals of engineering
  examination in this state or another jurisdiction, if:
               (1)  the applicant has engaged in the active practice
  of engineering for at least 15 years;
               (2)  the board determines that issuing or reissuing the
  license to the applicant does not pose a threat to the public
  health, safety, or welfare;
               (3)  the applicant requests a waiver in writing at the
  time the application is filed; and
               (4)  the applicant meets the educational requirement of
  Section 1001.302(a)(1).
         SECTION 2.  Section 1001.305, Occupations Code, as amended
  by this Act, applies only to an application for an engineering
  license that is filed on or after the effective date of this Act.  An
  application that was filed before the effective date of this Act is
  governed by the law in effect on the date the application was filed,
  and the former law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2025.
