A BILL TO BE ENTITLED
 
AN ACT
  relating to an additional fee for certain birth records to fund
  child abuse prevention programs; imposing a fee.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 191.0045, Health and Safety Code, is
  amended by amending Subsection (d) and adding Subsection (j) to
  read as follows:
         (d)  A local registrar or county clerk who issues a certified
  copy of a birth or death certificate shall charge the same fees as
  charged by the bureau of vital statistics, including the additional
  fees [fee] required under Subsections [Subsection] (e) and (j),
  except as provided by Subsections (g) and (h). A local registrar or
  county clerk shall send the fee collected under Subsection (j) to
  the comptroller, who shall deposit the money to the credit of the
  child abuse and neglect prevention trust fund account established
  under Section 40.105, Human Resources Code.
         (j)  In addition to fees collected by the bureau of vital
  statistics under Subsection (b), the bureau shall:
               (1)  collect an additional $2 fee for each of the
  following:
                     (A)  issuing a certified copy of a certificate of
  birth;
                     (B)  issuing a wallet-sized certification of
  birth; and
                     (C)  conducting a search for a certificate of
  birth; and
               (2)  send the fees collected under this subsection to
  the comptroller, who shall deposit the money to the credit of the
  child abuse and neglect prevention trust fund account established
  under Section 40.105, Human Resources Code.
         SECTION 2.  The fee authorized by Section 191.0045(j),
  Health and Safety Code, as added by this Act, applies only to a fee
  for a certificate or certification of birth issued, or a search for
  a certificate of birth requested, on or after September 1, 2013.
         SECTION 3.  This Act takes effect September 1, 2013.
