relating to the confidentiality of certain information in a peace | ||
officer's or firefighter's personnel file. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 552.102, Government Code, is amended by | ||
adding Subsection (c) to read as follows: | ||
(c) The following information in a peace officer's or | ||
firefighter's personnel file is confidential and excepted from the | ||
requirements of Section 552.021: | ||
(1) an application for employment; | ||
(2) information related to the process of hiring the | ||
peace officer or firefighter; and | ||
(3) a letter, memorandum, or other document relating | ||
to alleged misconduct by the peace officer or firefighter if the | ||
employing department: | ||
(A) determines that there is insufficient | ||
evidence to sustain the charge of misconduct; or | ||
(B) did not take disciplinary action against the | ||
peace officer or firefighter for the alleged misconduct. | ||
SECTION 2. The change in law made by this Act applies to | ||
information produced or maintained before, on, or after the | ||
effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2023. |
