relating to reimbursement rates for Medicaid acute care therapy | ||
services; making an appropriation. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. (a) In addition to other amounts appropriated to | ||
the Health and Human Services Commission for the state fiscal | ||
biennium ending August 31, 2019, the following amounts are | ||
appropriated to the commission for Medicaid acute care therapy | ||
services for the specified periods: | ||
(1) $34,180,000 from the economic stabilization fund | ||
and $44,977,018 from federal funds for the state fiscal year ending | ||
August 31, 2018; and | ||
(2) $35,995,000 from the economic stabilization fund | ||
and $48,262,959 from federal funds for the state fiscal year ending | ||
August 31, 2019. | ||
(b) It is the intent of the legislature that: | ||
(1) the Health and Human Services Commission allocate | ||
money appropriated under Subsection (a) of this section among | ||
provider types and procedure codes for Medicaid acute care therapy | ||
services in a manner that preserves access to care for clients | ||
served under the Medicaid fee-for-service and managed care delivery | ||
models; and | ||
(2) money appropriated under Subsection (a) of this | ||
section be fully reflected in reimbursement rates paid to Medicaid | ||
acute care therapy services providers under both the Medicaid | ||
fee-for-service and managed care delivery models. | ||
SECTION 2. The appropriation from the economic | ||
stabilization fund to the Trusteed Programs within the Office of | ||
the Governor for Strategy A.1.1., Disaster Funds, made by Chapter | ||
605 (S.B. 1), Acts of the 85th Legislature, Regular Session, 2017 | ||
(the General Appropriations Act), for the state fiscal biennium | ||
beginning September 1, 2017, is reduced by $70,175,000. | ||
SECTION 3. (a) Subject to Subsection (b) of this section: | ||
(1) this Act takes effect immediately if it receives a | ||
vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution; and | ||
(2) if this Act does not receive the vote necessary for | ||
immediate effect, this Act takes effect on the 91st day after the | ||
last day of the legislative session. | ||
(b) This Act takes effect only if it receives a vote of | ||
two-thirds of the members present in each house of the legislature, | ||
as provided by Section 49-g(m), Article III, Texas Constitution. |
