BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. The heading to Section 21.165, Penal Code, is | ||
amended to read as follows: | ||
Sec. 21.165. UNLAWFUL PRODUCTION OR DISTRIBUTION OF CERTAIN | ||
SEXUALLY EXPLICIT VISUAL MATERIAL [ |

SECTION 2. Sections 21.165 (a) and (b), Penal Code, are | ||
amended to read as follows: | ||
(a) In this section: | ||
(1) "Deep fake visual material [ |
||
material [ |
||
appears to depict a real person performing an action that did not | ||
occur in reality. | ||
(2) "Intimate parts" and "sexual conduct" have the meanings | ||
assigned by Section 21.16. | ||
(3) "Visual material" has the meaning assigned by Section | ||
43.26(b)(3), Penal Code. | ||
(b) A person commits an offense if, without the effective | ||
consent of the person appearing to be depicted, the person | ||
knowingly produces or distributes by electronic means a deep fake | ||
visual material [ |
||
person's intimate parts exposed or engaged in sexual conduct. | ||
SECTION 3. This Act takes effect September 1, 2025. |
