relating to county consent for certain municipal annexations. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 43, Local Government Code, | ||
is amended by adding Section 43.035 to read as follows: | ||
Sec. 43.035. COUNTY CONSENT REQUIRED FOR CERTAIN | ||
ANNEXATIONS. A municipality with a population of more than 300,000 | ||
may not annex an area located in a county with a population of more | ||
than 50,000 and less than 300,000 without the consent of that | ||
county. | ||
SECTION 2. Section 43.035, Local Government Code, as added | ||
by this Act, applies only to an annexation that is not final on or | ||
after the effective date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
