relating to the effect of the amendment of certain documents | ||
incorporated by reference into the laws or policy of this state on | ||
related state agency rules. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 2001, Government Code, is | ||
amended by adding Section 2001.008 to read as follows: | ||
Sec. 2001.008. EFFECT OF AMENDMENT OF DOCUMENTS | ||
INCORPORATED BY REFERENCE ON CERTAIN RULES. A state agency in the | ||
manner provided by this chapter shall readopt, readopt with | ||
amendments, or repeal a previously adopted rule if: | ||
(1) the rule implements, interprets, or prescribes a | ||
law or policy of this state that incorporates by reference a | ||
document that is not another law or policy of this state; and | ||
(2) as a result of an amendment to the document that is | ||
incorporated by reference into the law or policy the rule | ||
implements, interprets, or prescribes, the rule would: | ||
(A) allow the agency to expand its regulatory | ||
authority over a matter that involves a major question of state | ||
policy; or | ||
(B) impose a greater economic burden on persons | ||
required to comply with the rule or on the economy of this state. | ||
SECTION 2. This Act takes effect September 1, 2023. |
