| relating to the effect of the amendment of certain documents | ||
| incorporated by reference into the laws or policy of this state on | ||
| related state agency rules. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 2001, Government Code, is | ||
| amended by adding Section 2001.008 to read as follows: | ||
| Sec. 2001.008. EFFECT OF AMENDMENT OF DOCUMENTS | ||
| INCORPORATED BY REFERENCE ON CERTAIN RULES. A state agency in the | ||
| manner provided by this chapter shall readopt, readopt with | ||
| amendments, or repeal a previously adopted rule if: | ||
| (1) the rule implements, interprets, or prescribes a | ||
| law or policy of this state that incorporates by reference a | ||
| document that is not another law or policy of this state; and | ||
| (2) as a result of an amendment to the document that is | ||
| incorporated by reference into the law or policy the rule | ||
| implements, interprets, or prescribes, the rule would: | ||
| (A) allow the agency to expand its regulatory | ||
| authority over a matter that involves a major question of state | ||
| policy; or | ||
| (B) impose a greater economic burden on persons | ||
| required to comply with the rule or on the economy of this state. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
