| relating to the authority of a governmental unit that has withdrawn | ||
| from a regional planning commission to join another regional | ||
| planning commission. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 391, Local Government Code, is amended | ||
| by adding Section 391.016 to read as follows: | ||
| Sec. 391.016. JOINING COMMISSION AFTER WITHDRAWAL. A | ||
| governmental unit that has withdrawn from a commission under | ||
| Section 391.015 may join another commission that is adjacent to the | ||
| unit if: | ||
| (1) the transfer is approved by the governing bodies | ||
| of: | ||
| (A) the unit; and | ||
| (B) the commission the unit wishes to join; | ||
| (2) the governmental unit submits a written request | ||
| for approval of the transfer to the governor that: | ||
| (A) is in the form and manner prescribed by the | ||
| office of the governor; and | ||
| (B) demonstrates the transfer furthers the | ||
| purpose of this chapter as described by Section 391.001; and | ||
| (3) the governor approves the transfer. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
