A BILL TO BE ENTITLED
 
AN ACT
  relating to the appointment of members to policy boards of certain
  metropolitan planning organizations.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 472, Transportation Code,
  is amended by adding Section 472.037 to read as follows:
         Sec. 472.037.  APPOINTMENT OF MEMBERS TO CERTAIN POLICY
  BOARDS. (a)  This section applies only to a metropolitan planning
  organization that serves a county with a population of more than
  four million.
         (b)  Counties served by a metropolitan planning organization
  described by Subsection (a) shall appoint voting members to the
  organization's policy board as follows:
               (1)  a county with a population of four million or more
  shall appoint two members;
               (2)  a county with a population of less than four
  million but more than 45,000 shall appoint one member; and
               (3)  a county with a population of 45,000 or less,
  together with an adjacent county with a population of 45,000 or
  less, shall jointly appoint one member.
         (c)  Municipalities served by a metropolitan planning
  organization described by Subsection (a) shall appoint voting
  members to the organization's policy board as follows:
               (1)  a municipality with a population of two million or
  more shall appoint two members; and
               (2)  a municipality with a population of less than two
  million but more than 25,000 shall appoint one member.
         (d)  The department shall appoint three members to the policy
  board of a metropolitan planning organization described by
  Subsection (a).
         (e)  A metropolitan transit authority or rail district
  served by a metropolitan planning organization described by
  Subsection (a) shall appoint one voting member to the
  organization's policy board.
         (f)  A port authority located in a municipality with a
  population of more than two million that is served by a metropolitan
  planning organization described by Subsection (a) shall appoint one
  voting member to the organization's policy board.
         (g)  The governor shall appoint two voting members to the
  policy board of a metropolitan planning organization described by
  Subsection (a).
         (h)  Each member of a policy board of a metropolitan planning
  organization described by Subsection (a) is entitled to one vote.
         SECTION 2.  This Act takes effect September 1, 2023.
