| transit facilities and vehicles. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 372, Transportation Code, | ||
| is amended by adding Section 372.002 to read as follows: | ||
| Sec. 372.002. ACCOMMODATION OF MASS TRANSIT FACILITIES AND | ||
| VEHICLES. The governing body of a toll project entity may not adopt | ||
| a plan for the construction of a toll project unless the plan | ||
| includes measures for the toll project to accommodate | ||
| high-occupancy vehicles of mass transit agencies, including buses | ||
| and carpool and vanpool vehicles. Accommodations under this section | ||
| must include: | ||
| (1) land, capital funding, and operating costs for the | ||
| construction and operation of park and ride facilities; and | ||
| (2) the free use of the project by mass transit | ||
| high-occupancy vehicles. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to a toll project for which an initial plan is adopted on or after | ||
| September 1, 2017. | ||
| SECTION 3. This Act takes effect September 1, 2017. | ||
