relating to a disciplinary proceeding for a professional employee | ||
of a school district based on the employee's use of physical force | ||
against a student. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 22.0512(a), Education Code, is amended | ||
to read as follows: | ||
(a) A professional employee of a school district may not be | ||
subject to disciplinary proceedings for the employee's objectively | ||
reasonable use of physical force against a student to the extent | ||
justified under Section 9.62, Penal Code. | ||
SECTION 2. This Act applies only to a school district | ||
employee disciplinary proceeding for conduct that occurs on or | ||
after the effective date of this Act. A school district employee | ||
disciplinary proceeding for conduct that occurs before the | ||
effective date of this Act is governed by the law in effect on the | ||
date the conduct occurs, and that law is continued in effect for | ||
that purpose. | ||
SECTION 3. This Act takes effect September 1, 2011. |
