| payment disputes with chiropractors. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 1952, Insurance Code, is | ||
| amended by adding Section 1952.1561 to read as follows: | ||
| Sec. 1952.1561. PAYMENT DISPUTES RELATING TO CHIROPRACTIC | ||
| CARE. (a) An insurer may not bring an action related to a payment | ||
| required under Section 1952.156 made for chiropractic care unless | ||
| not later than one year after the date of service the chiropractor | ||
| and the insurer have submitted the dispute to an alternative | ||
| dispute resolution process and failed to resolve the dispute. | ||
| (b) The statute of limitations applicable to a cause of | ||
| action arising out of the dispute is tolled beginning on the date | ||
| the dispute arises and ending on the date the alternative dispute | ||
| resolution process is completed. | ||
| SECTION 2. This Act applies only to an insurance policy that | ||
| is delivered, issued for delivery, or renewed on or after January 1, | ||
| 2014. A policy delivered, issued for delivery, or renewed before | ||
| January 1, 2014, is governed by the law as it existed immediately | ||
| before the effective date of this Act, and that law is continued in | ||
| effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2013. | ||
