relating to a temporary abatement of evictions for failure to pay | ||
rent during and after a disaster. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 24, Property Code, is amended by adding | ||
Section 24.012 to read as follows: | ||
Sec. 24.012. TEMPORARY ABATEMENT OF EVICTION DURING AND | ||
AFTER DISASTER. (a) In this section, "state of disaster" means a | ||
state of disaster declared by the governor under Section 418.014, | ||
Government Code. | ||
(b) This section applies only to an eviction based on a | ||
tenant's nonpayment of rent. | ||
(c) An action under this chapter to evict a tenant is | ||
automatically abated without a court order during the period a | ||
state of disaster is in effect and until the 61st day after the date | ||
a state of disaster ends. | ||
(d) During the period a state of disaster is in effect and | ||
until the 61st day after the date a state of disaster ends, an | ||
officer may not execute a writ of possession relating to the | ||
eviction of a tenant. | ||
SECTION 2. This Act takes effect September 1, 2021. |
