A BILL TO BE ENTITLED
AN ACT
relating to the right of property owners' association members to
speak at an association or board meeting.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 209, Property Code, is amended by adding
Section 209.00511 to read as follows:
Sec. 209.00511. MEMBER'S RIGHT TO SPEAK AT MEETING. (a)
Except as otherwise provided by this section, an association member
is entitled to speak at any association meeting, including a board
meeting, regardless of whether the meeting is held in person,
electronically, or by telephone.
(b) The board may place reasonable limitations on the time
and manner in which a member is allowed to speak but may not impose
requirements that restrict a member's ability to express the
member's concerns.
(c) This section does not entitle an association member to
speak at a portion of a board meeting conducted in executive
session.
SECTION 2. This Act takes effect September 1, 2023.
