relating to venue for the appeal of a judgment of a district court | ||
determining an ad valorem tax appeal. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 42.28, Tax Code, is amended to read as | ||
follows: | ||
Sec. 42.28. APPEAL OF DISTRICT COURT JUDGMENT. (a) Except | ||
as provided by Subsection (b), a [ |
||
judgment of the district court as provided by law for appeal of | ||
civil suits generally, except that an appeal bond is not required of | ||
the chief appraiser, the county, the comptroller, or the | ||
commissioners court. | ||
(b) An appeal under this section shall be brought in the | ||
Court of Appeals for the Third Court of Appeals District. | ||
SECTION 2. The change in law made by this Act to Section | ||
42.28, Tax Code, applies only to an appeal filed under Chapter 42, | ||
Tax Code, on or after the effective date of this Act. An appeal | ||
filed under Chapter 42, Tax Code, before the effective date of this | ||
Act is governed by the law in effect when the appeal was filed, and | ||
the former law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2015. |
