relating to parties who may bring suit under the Texas Free | ||
Enterprise and Antitrust Act of 1983. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 15.21, Business & Commerce Code, is | ||
amended by adding Subsection (d) to read as follows: | ||
(d) A person whose business or property has been injured by | ||
reason of any conduct prohibited or declared unlawful by this | ||
chapter may sue another person as provided by this section, | ||
regardless of whether the injured person dealt directly or | ||
indirectly with the defendant. | ||
SECTION 2. Section 15.21(d), Business & Commerce Code, as | ||
added by this Act, applies only to a cause of action that occurred | ||
on or after the effective date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2015. |
