relating to the state purchasing preference for recycled, | ||
remanufactured, or environmentally sensitive products. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 2155.445, Government Code, is amended by | ||
amending Subsection (b) and adding Subsection (e) to read as | ||
follows: | ||
(b) The comptroller regularly shall review and revise its | ||
procurement procedures and specifications for the purchase of goods | ||
to: | ||
(1) eliminate procedures and specifications that | ||
explicitly discriminate against recycled, remanufactured, or | ||
environmentally sensitive products, as those terms are defined by | ||
rule of the comptroller; [ |

(2) encourage the use of recycled, remanufactured, or | ||
environmentally sensitive products; and | ||
(3) require that any information regarding the | ||
recycled, remanufactured, or environmentally sensitive nature of a | ||
product that is used as the basis for receiving a preference be | ||
certified as accurate by an entity approved by the comptroller. | ||
(e) A state agency shall provide notice of the preference | ||
under this section in all solicitation documents for purchases by | ||
the agency of goods for which the preference may be given, including | ||
the method the agency will use to evaluate, apply, and award the | ||
preference. | ||
SECTION 2. This Act takes effect September 1, 2021. |
