relating to a reduction of the amount required to be paid by certain | ||
school districts to achieve the equalized wealth level under the | ||
public school finance system. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter D, Chapter 41, Education Code, is | ||
amended by adding Section 41.0933 to read as follows: | ||
Sec. 41.0933. REDUCTION FOR MAINTENANCE AND OPERATIONS | ||
COSTS. (a) This section applies only to a school district in which | ||
at least 65 percent of the enrolled students are educationally | ||
disadvantaged or at risk of dropping out of school, as defined by | ||
Section 29.081(d). | ||
(b) Notwithstanding any other provision of this chapter, a | ||
school district to which this section applies that executes an | ||
agreement to purchase all attendance credits necessary to reduce | ||
the district's wealth per student to the equalized wealth level may | ||
reduce the total amount required to be paid for attendance credits | ||
under Section 41.093 by 25 percent. | ||
(c) A reduction under Subsection (b) shall be made after | ||
making any reduction to which the district is entitled under | ||
Section 41.0931, 41.097, or 41.098 or another provision of this | ||
chapter. | ||
(d) The district shall use amounts available to the district | ||
as a result of this section to pay district maintenance and | ||
operations costs. | ||
SECTION 2. This Act takes effect September 1, 2017, if this | ||
Act receives a vote of two-thirds of all the members elected to each | ||
house, as provided by Section 39, Article III, Texas Constitution. | ||
If this Act does not receive the vote necessary for effect on that | ||
date, this Act takes effect on the 91st day after the last day of the | ||
legislative session. |
