| relating to the intersection of a free road and a toll road. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 372, Transportation Code, is amended by | ||
| adding Subchapter C to read as follows: | ||
| SUBCHAPTER C. INTERSECTION OF TOLL PROJECT AND FREE ROAD | ||
| Sec. 372.101. DEFINITION. In this subchapter, "free road" | ||
| includes a street or public highway. | ||
| Sec. 372.102. CONSTRUCTION OF TOLL PROJECT. A toll project | ||
| entity may not construct a toll project that intersects with a free | ||
| road unless the toll project is constructed or a traffic control | ||
| signal is used in a manner that allows traffic on the free road to | ||
| flow freely without yielding or stopping for toll project traffic. | ||
| SECTION 2. This Act applies only to construction of a toll | ||
| project, as defined by Section 372.001, Transportation Code that | ||
| begins on or after the effective date of this Act. A toll project | ||
| the construction of which begins before the effective date of this | ||
| Act is governed by the law in effect on the date of the beginning of | ||
| the construction, and the former law is continued in effect for that | ||
| purpose. | ||
| SECTION 3. This Act takes effect September 1, 2013. | ||
