A BILL TO BE ENTITLED
 
AN ACT
  relating to a credit against required recapture payments for
  certain school districts with excess facilities costs under the
  public school finance system.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 49, Education Code, is
  amended by adding Section 49.1571 to read as follows:
         Sec. 49.1571.  CREDIT FOR CERTAIN FACILITIES COSTS. (a)  
  This section applies only to a school district located in a county
  that borders on the Gulf of Mexico.
         (b)  The total amount required under Section 49.153 for a
  school district to which this section applies to purchase
  attendance credit under this subchapter for any school year is
  reduced by an amount equal to the amount of money spent by the
  district in the preceding school year to:
               (1)  perform necessary facility maintenance,
  renovations, and repairs attributable to damage resulting from
  natural conditions associated with the facility's proximity to the
  Gulf of Mexico; and
               (2)  pay for property insurance to cover the costs of
  facility maintenance, renovations, and repairs described by
  Subdivision (1).
         (c)  A reduction under Subsection (b) shall be made after
  making any reduction to which the district is entitled under
  Section 49.157 or another provision of this chapter.
         SECTION 2.  This Act takes effect September 1, 2021.
