relating to the adoption and permanent student ownership of | ||
low-cost mathematics and science instructional material. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 31.023, Education Code, is amended by | ||
adding Subsection (c) to read as follows: | ||
(c) The State Board of Education may adopt a list of | ||
mathematics and science instructional material that may be offered | ||
to school districts at a low cost. The board may adopt rules for the | ||
review and adoption of instructional material under this | ||
subsection. Sections 31.022, 31.0221, 31.026, and 31.027 do not | ||
apply to instructional material adopted under this subsection. | ||
SECTION 2. Section 31.102(a), Education Code, is amended to | ||
read as follows: | ||
(a) Except as provided by Section 31.104(i), each [ |
||
instructional material purchased as provided by this chapter for a | ||
school district or an open-enrollment charter school is the | ||
property of the district or school. | ||
SECTION 3. Section 31.104, Education Code, is amended by | ||
amending Subsection (c) and adding Subsection (i) to read as | ||
follows: | ||
(c) Except as provided by Subsections [ |
||
(i), a student must return all instructional materials to the | ||
teacher at the end of the school year or when the student withdraws | ||
from school. | ||
(i) At the end of the school year, instructional material | ||
adopted by the State Board of Education under Section 31.023(c) and | ||
purchased by a school district or open-enrollment charter school as | ||
a low-cost mathematics or science instructional material becomes | ||
the property of the student to whom it was distributed. A school | ||
district or open-enrollment charter school may not charge a fee | ||
under this subsection. | ||
SECTION 4. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
