sewer service corporation. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 67, Water Code, is amended by adding | ||
Section 67.0115 to read as follows: | ||
Sec. 67.0115. LIMITATION ON FEES FOR SCHOOL DISTRICTS. (a) | ||
In this section, "impact fee" means a charge imposed by a | ||
corporation against new development to pay for capital improvements | ||
or facility expansions necessitated by the new development. The | ||
term includes amortized charges, lump-sum charges, capital | ||
recovery fees, contributions in aid of construction, and any other | ||
fee that functions as described by this definition. | ||
(b) A corporation may not charge a school district an impact | ||
fee or a fee to acquire water rights unless the board of trustees of | ||
the district enters into a contract with the corporation for | ||
payment of the fees. The contract may contain terms the board of | ||
trustees considers advisable to provide for payment of the fees. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
