A BILL TO BE ENTITLED
 
AN ACT
  relating to the jurisdiction of courts in criminal matters
  involving allegations of sexual assault by a member of the state
  military forces.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 432, Government Code, is
  amended by adding Section 432.006 to read as follows:
         Sec. 432.006.  PROSECUTION OF SEXUAL ASSAULT. (a) A
  criminal case alleging a sexual assault committed by a member of the
  state military forces must first be tried in an appropriate state
  court with jurisdiction over the case. 
         (b)  A military court may not try a person subject to this
  chapter for committing an offense described by Subsection (a) until
  any state prosecution of the offense is complete. 
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
