| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 432, Government Code, is | ||
| amended by adding Section 432.006 to read as follows: | ||
| Sec. 432.006. PROSECUTION OF SEXUAL ASSAULT. (a) A | ||
| criminal case alleging a sexual assault committed by a member of the | ||
| state military forces must first be tried in an appropriate state | ||
| court with jurisdiction over the case. | ||
| (b) A military court may not try a person subject to this | ||
| chapter for committing an offense described by Subsection (a) until | ||
| any state prosecution of the offense is complete. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
