relating to mandatory accreditation for certain chemical | ||
dependency treatment facilities. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 464.001, Health and Safety Code, is | ||
amended by amending Subdivision (1) and adding Subdivision (2) to | ||
read as follows: | ||
(1) "Accreditation commission" means the Commission | ||
on Accreditation of Rehabilitation Facilities, the Joint | ||
Commission, or another national accreditation organization | ||
recognized by the department. | ||
(2) "Chemical dependency" means: | ||
(A) abuse of alcohol or a controlled substance; | ||
(B) psychological or physical dependence on | ||
alcohol or a controlled substance; or | ||
(C) addiction to alcohol or a controlled | ||
substance. | ||
SECTION 2. Subchapter A, Chapter 464, Health and Safety | ||
Code, is amended by adding Sections 464.0053 and 464.0054 to read as | ||
follows: | ||
Sec. 464.0053. MANDATORY ACCREDITATION FOR CERTAIN | ||
TREATMENT FACILITIES. (a) A treatment facility that provides | ||
medical assistance under Chapter 32, Human Resources Code, or | ||
through a Medicaid managed care organization under Chapter 533, | ||
Government Code, to an individual, must be accredited by an | ||
accreditation commission. | ||
(b) This section does not apply to an inmate substance abuse | ||
treatment program operated by or under contract with the Texas | ||
Department of Criminal Justice. | ||
Sec. 464.0054. ACCREDITATION REQUIRED FOR CERTAIN | ||
TREATMENT FACILITIES. A treatment facility that is required to be | ||
licensed under this chapter must, whether applying for an initial | ||
license or the renewal of a license, submit documentation | ||
indicating that the facility is accredited. | ||
SECTION 3. Section 464.0055(d), Health and Safety Code, is | ||
repealed. | ||
SECTION 4. Section 464.0054, Health and Safety Code, as | ||
added by this Act, applies only to the renewal of a license to | ||
operate a chemical dependency treatment facility that expires on or | ||
after the effective date of this Act. A license that expires before | ||
that date is governed by the law in effect on the date the license | ||
expires, and the former law is continued in effect for that purpose. | ||
SECTION 5. This Act takes effect September 1, 2021. |
