A BILL TO BE ENTITLED
 
AN ACT
  relating to requiring notice and the dissemination of criminal
  history record information to the subject of the information in
  certain circumstances.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter F, Chapter 411, Government Code, is
  amended by adding Section 411.0831 to read as follows:
         Sec. 411.0831.  REQUIRED DISSEMINATION TO SUBJECT OF
  CRIMINAL HISTORY RECORD INFORMATION. (a)  If an individual or
  entity requests access to criminal history record information under
  Section 411.083, the department shall provide written notice by
  mail to the person who is the subject of the information at the same
  time the department discloses or disseminates the information to
  the requesting individual or entity. The notice must:
               (1)  inform the person that an individual or entity
  requested access to the person's criminal history record
  information;
               (2)  identify the individual or entity; and
               (3)  include a copy of the criminal history record
  information provided to the individual or entity in response to the
  request.
         (b)  Subsection (a) does not apply to requests for access to
  criminal history record information made under Section
  411.083(b)(1) or (3).
         SECTION 2.  The change in law made by this Act applies only
  to a request for access to criminal history record information made
  on or after the effective date of this Act.  A request for access to
  criminal history record information made before the effective date
  of this Act is governed by the law in effect on the date the request
  was made, and the former law is continued in effect for that
  purpose.
         SECTION 3.  This Act takes effect September 1, 2015.
