relating to requiring notice and the dissemination of criminal | ||
history record information to the subject of the information in | ||
certain circumstances. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter F, Chapter 411, Government Code, is | ||
amended by adding Section 411.0831 to read as follows: | ||
Sec. 411.0831. REQUIRED DISSEMINATION TO SUBJECT OF | ||
CRIMINAL HISTORY RECORD INFORMATION. (a) If an individual or | ||
entity requests access to criminal history record information under | ||
Section 411.083, the department shall provide written notice by | ||
mail to the person who is the subject of the information at the same | ||
time the department discloses or disseminates the information to | ||
the requesting individual or entity. The notice must: | ||
(1) inform the person that an individual or entity | ||
requested access to the person's criminal history record | ||
information; | ||
(2) identify the individual or entity; and | ||
(3) include a copy of the criminal history record | ||
information provided to the individual or entity in response to the | ||
request. | ||
(b) Subsection (a) does not apply to requests for access to | ||
criminal history record information made under Section | ||
411.083(b)(1) or (3). | ||
SECTION 2. The change in law made by this Act applies only | ||
to a request for access to criminal history record information made | ||
on or after the effective date of this Act. A request for access to | ||
criminal history record information made before the effective date | ||
of this Act is governed by the law in effect on the date the request | ||
was made, and the former law is continued in effect for that | ||
purpose. | ||
SECTION 3. This Act takes effect September 1, 2015. |
