A BILL TO BE ENTITLED

AN ACT
relating to the execution of a search warrant for taking a blood

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Chapter 18, Code of Criminal Procedure, is
amended by adding Article 18.065 to read as follows:
Art. 18.065.  WARRANT FOR BLOOD SPECIMEN IN INTOXICATION
OFFENSE MAY BE EXECUTED IN CONTIGUOUS COUNTY. Notwithstanding any
other law, a warrant issued under Article 18.02(10) to collect a

  intoxication offense under Section 49.04, 49.045, 49.05, 49.06,
49.065, 49.07, or 49.08, Penal Code, may be executed in a county

outside the county in which that court is located.
SECTION 2.  The change in law made by this Act applies only
to a search warrant issued on or after the effective date of this
Act. A search warrant issued before the effective date of this Act
