relating to the width requirements for an area annexed by a | ||
municipality. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 43.054, Local Government Code, is | ||
amended by adding Subsections (d) and (e) to read as follows: | ||
(d) A municipality may not annex an area if the width of the | ||
area at the widest point exceeds the length of the area at the | ||
longest point. | ||
(e) The prohibition established by Subsection (d) does not | ||
apply if: | ||
(1) the boundaries of the municipality are contiguous | ||
to the area on at least two sides; or | ||
(2) the area abuts or is contiguous to another | ||
jurisdictional boundary. | ||
SECTION 2. The change in law made by Section 43.054(d), | ||
Local Government Code, as added by this Act, applies to an area | ||
proposed for annexation on or after the effective date of this Act | ||
or before the effective date of this Act if the statutory | ||
requirements for annexation under Subchapter C or C-1, Chapter 43, | ||
Local Government Code, have not been completed before the effective | ||
date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2015. |
