| relating to certain restrictions on funds administered by the | ||
| Department of Agriculture. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 12, Agriculture Code, is amended by | ||
| adding Section 12.049 to read as follows: | ||
| Sec. 12.049. LIMITATIONS ON RESTRICTIONS ON FUNDS | ||
| ADMINISTERED BY DEPARTMENT. The distribution of money from a fund | ||
| administered by the department to encourage private economic | ||
| development may not be restricted on the basis of whether the county | ||
| in which or to which the funds are distributed has adopted or | ||
| enforces subdivision regulations, including the model rules | ||
| established under Section 16.343, Water Code. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
