A BILL TO BE ENTITLED
 
AN ACT
  relating to where a justice of the peace court is held.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 27.051(f), Government Code, is amended
  to read as follows:
         (f)  A justice of the peace [of a precinct in a county with a
  population of less than 30,000] may hold court in the county
  courthouse or another facility provided under Section 292.002(a),
  Local Government Code, for that purpose. If requested by the
  justice, the commissioners court of the county may provide and
  furnish a suitable place in the courthouse or another facility
  provided under Section 292.002(a), Local Government Code, for the
  justice to hold court.
         SECTION 2.  Section 292.001(d), Local Government Code, is
  amended to read as follows:
         (d)  Notwithstanding Subsection (b), a [A] justice of the
  peace court may [not] be housed or conducted in a building located
  inside or outside the county seat [court's precinct except as
  provided by Section 27.051(f), Government Code, or unless the
  justice of the peace court is situated in the county courthouse in a
  county with a population of at least 242,000 persons but no more
  than 248,000 persons].
         SECTION 3.  This Act takes effect September 1, 2011.
