A BILL TO BE ENTITLED
 
AN ACT
  relating to a manufacturer's disclosure of cosmetic ingredients;
  authorizing an administrative penalty.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter F, Chapter 431, Health and Safety
  Code, is amended by adding Section 431.143 to read as follows:
         Sec. 431.143.  MANUFACTURER DISCLOSURE. (a) A manufacturer
  selling a cosmetic in this state shall disclose on the
  manufacturer's Internet website:
               (1)  a list of each ingredient in the cosmetic,
  including a fragrance, flavor, and color additive, in order of
  predominance except the ingredients with a concentration of less
  than one percent may be listed in any order for purposes of
  protecting a trade secret; and
               (2)  the chemical abstract service number for each
  listed ingredient.
         (b)  A manufacturer is not required to list the concentration
  of each ingredient in a cosmetic under Subsection (a).
         SECTION 2.  Section 431.054(a), Health and Safety Code, is
  amended to read as follows:
         (a)  The department may assess an administrative penalty
  against a person who violates Subchapter B, Section 431.143, or an
  order adopted or registration issued under this chapter.
         SECTION 3.  This Act takes effect September 1, 2025.
