authorizing an administrative penalty. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter F, Chapter 431, Health and Safety | ||
Code, is amended by adding Section 431.143 to read as follows: | ||
Sec. 431.143. MANUFACTURER DISCLOSURE. (a) A manufacturer | ||
selling a cosmetic in this state shall disclose on the | ||
manufacturer's Internet website: | ||
(1) a list of each ingredient in the cosmetic, | ||
including a fragrance, flavor, and color additive, in order of | ||
predominance except the ingredients with a concentration of less | ||
than one percent may be listed in any order for purposes of | ||
protecting a trade secret; and | ||
(2) the chemical abstract service number for each | ||
listed ingredient. | ||
(b) A manufacturer is not required to list the concentration | ||
of each ingredient in a cosmetic under Subsection (a). | ||
SECTION 2. Section 431.054(a), Health and Safety Code, is | ||
amended to read as follows: | ||
(a) The department may assess an administrative penalty | ||
against a person who violates Subchapter B, Section 431.143, or an | ||
order adopted or registration issued under this chapter. | ||
SECTION 3. This Act takes effect September 1, 2025. |
