relating to the appointment of a deputy constable. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 86.011(a), Local Government Code, is | ||
amended to read as follows: | ||
(a) An elected constable who desires to appoint a deputy | ||
must apply in writing to the commissioners court of the county and | ||
show that it is necessary to appoint a deputy in order to properly | ||
handle the business of the constable's office that originates in | ||
the constable's precinct. [ |

commissioners court determines that the constable needs a deputy to | ||
handle the business originating in the precinct. | ||
SECTION 2. The change in law made by this Act to Section | ||
86.011(a), Local Government Code, applies only to an application | ||
submitted to a commissioners court on or after the effective date of | ||
this Act. An application submitted to a commissioners court before | ||
the effective date of this Act is governed by the law in effect when | ||
the application was submitted, and the former law is continued in | ||
effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2013. |
