relating to requirements for providing documents and written | ||
information to certain owners of property subject to the exercise | ||
of eminent domain authority. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 21.0112, Property Code, is amended by | ||
amending Subsection (b) and adding Subsection (c) to read as | ||
follows: | ||
(b) The statement must [ |

(1) be printed in an easily readable font and type | ||
size; and | ||
(2) if the entity is a governmental entity: | ||
(A) be [ |
||
of the entity if technologically feasible; and | ||
(B) include a provision informing the property | ||
owner that the entity is required to provide all documents and | ||
written information required under this chapter to be provided to | ||
the property owner printed in English, Spanish, or any other | ||
language requested by the property owner. | ||
(c) A governmental entity shall provide to a property owner | ||
all documents and written information required under this chapter | ||
to be provided to the property owner printed in English, Spanish, or | ||
any other language requested by the property owner. | ||
SECTION 2. The changes in law made by Section 21.0112, | ||
Property Code, as amended by this Act, apply only to a condemnation | ||
in which the final offer is made by a governmental entity on or | ||
after the effective date of this Act. A condemnation in which the | ||
final offer is made before the effective date of this Act is | ||
governed by the law in effect on the date the offer was made, and the | ||
former law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2011. |
