BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. The heading to Chapter 28A, Water Code, is | ||
amended to read as follows: | ||
CHAPTER 28A. REGULATION [ |

AGGREGATE PRODUCTION OPERATIONS | ||
SECTION 2. The heading to Subchapter B, Chapter 28A, Water | ||
Code, is amended to read as follows: | ||
SUBCHAPTER B. REGISTRATION, [ |
||
SECTION 3. Subchapter B, Chapter 28A, Water Code, is | ||
amended by adding Section 28A.055 to read as follows: | ||
Sec. 28A.055. BEST MANAGEMENT PRACTICES. The commission | ||
shall adopt and make accessible on the commission's Internet | ||
website best management practices for aggregate production | ||
operations to comply with applicable environmental laws and rules. | ||
SECTION 4. As soon as practicable after the effective date | ||
of this Act, the Texas Commission on Environmental Quality shall | ||
adopt the best management practices required under Section 28A.055, | ||
Water Code, as added by this Act. | ||
SECTION 5. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
